Artooka ("Artooka", "we", "us", or "our") offers a Platform through which users ("you", "your", or "User") may purchase floral and related products from independent third-party vendors ("Sellers"). You may use the Platform to purchase products that you then cause to be delivered to another person you know. If you do, we refer to you as the "Sender", and the person to whom you send products as the "Recipient".

This Privacy Policy outlines how we collect, use, store, and disclose your personal information in connection with your use of our website and services (together the "Platform").

By accessing or using the Platform, or providing us with personal information, you consent to the practices described in this Privacy Policy. If you do not agree with any terms of this Privacy Policy, please exercise the choices we describe below, or do not use the Platform and do not give us any personal information.

1. COMPANY INFORMATION

Artooka is a sole proprietorship registered in Ontario, Canada.

2. INFORMATION WE COLLECT

We collect the following categories of personal information:

  • Identity Information: Names of both the Sender and, if different, the Recipient.
  • Contact Information: Mailing address, email address, and phone numbers of both the Sender and, if different, the Recipient.
  • Delivery Information: Delivery address of the Recipient if different from the Sender; if not, the address of the Sender will be the delivery location.
  • Transactional Information: Order details, product selection, and delivery instructions (note that it may not be possible to accommodate all instructions).
  • Payment Information: Payment card data (processed via third-party payment processors; we do not store credit card details).
  • Occasion Information and Personal Greeting: Type of occasion (e.g., birthday, anniversary), date, and any greeting or message you wish to provide to the Recipient.
  • Preference Information: We retain information regarding your preference settings such as whether you have chosen to receive promotional offers from us.
  • General Location Data: Sender and Recipient locations (used for delivery and experience optimization). We also collect general location (e.g., your region) derived from your IP address, to better adjust the Platform to your region.
  • Account Information: Login credentials and order history.

In most cases, we collect personal information directly from you or your device. In other cases we may collect your personal information indirectly, for example, if you provide us with the mailing address of a person to whom you wish to send flowers or other products.

If you wish to send products to another person, you may only provide the information of friends or family if you have received their permission to provide us with their personal information for this purpose. By ordering flowers for another person, you are telling us that you have the consent of that person to provide us, the Seller, and the delivery company with their contact information for the purpose of fulfilling your order. You may not ask us to deliver to any person who has not provided consent, or who would consider delivery, messages, or a gift from you to be unwelcome. You also agree that we may let the Recipient know who the Sender is, and provide them with any personalized message you provide.

3. HOW WE USE YOUR INFORMATION

We use your information to:

  • Process, fulfill, and confirm orders
  • Facilitate delivery through third-party Sellers
  • Send transactional notices such as order confirmations and delivery notices to both the Sender and the Recipient, and to send the Sender marketing and occasion-based communications if they agree to receive them
  • Provide customer support and manage inquiries
  • Analyze performance and improve the Platform
  • Help ensure legal and regulatory compliance
  • Help detect and prevent fraud or abuse
  • Send email and other communications about our products and services, such as newsletters, announcements, and special offers
  • Respond to your questions or inquiries
  • For other purposes which are disclosed to you and to which you consent, or that are required or permitted by applicable law

We may also anonymize, aggregate, or otherwise strip any personal information of all personally identifying characteristics and may use or share that aggregated, anonymized data with third parties for any purpose we deem appropriate.

4. DATA RETENTION

We retain personal information for as long as necessary to fulfill the purposes outlined above, unless a longer retention period is required by law. Occasion dates may be retained for the purpose of sending future reminders.

5. SHARING AND DISCLOSURE

We may share your personal information with:

  • Third-party Sellers to fulfill and deliver orders. When you place an order, your name and phone number, the name of the Recipient and their delivery address, the details of your order, and any card or delivery message you provide is given to the Seller to allow them to fulfill your order.
  • Payment processors that handle payment card transactions on our behalf
  • Third-party service providers that assist us with carrying out any of the purposes described in this Privacy Policy
  • Analytics providers (e.g., Google Analytics)
  • Map and location services (e.g., if you use a map integration to indicate the location for delivery)
  • Legal and regulatory authorities if required to comply with applicable law, or if we deem it necessary to protect our rights, or those of Sellers or Users of our Platform

We reserve the right to transfer any personal information we have in the event of bankruptcy, or if we or any part of our business merges with or is acquired by a third party, or if any such transaction is proposed.

We may also disclose personal information for other purposes which are disclosed to you and to which you consent.

6. COOKIES AND TRACKING TECHNOLOGIES

A cookie is a small file which is placed on your computer or mobile device's hard drive. We may use cookies, pixels, and similar technologies to collect information that helps us operate and understand the use of our Platform, such as IP address, browser type, device data, language settings, and referral URL.

We use cookies, pixels, and similar technologies to:

  • Analyze site usage and improve performance
  • Remember your preferences and settings
  • Customize and personalize your experience
  • Provide localized product and delivery options

You may disable cookies via your browser settings, but some features of the Platform may not function properly.

We may use third-party analytics tools to better understand who is using the Platform and how they are using it. For example, we use Google Analytics to better understand usage patterns. Google Analytics uses cookies to collect and store information such as pages visited, places where users click, time spent on each page, IP address, type of operating system used, and device ID. We use this information to improve the Platform and as otherwise described in this Privacy Policy.

7. SECURITY

We implement physical, technical, and organizational measures to help protect your personal information against unauthorized access, loss, misuse, or alteration.

Personal information may be accessed by persons within our organization, or our third-party service providers, who require such access to carry out the purposes described in this Privacy Policy, or otherwise permitted or required by applicable law.

Despite our efforts, no method of transmission or storage is completely secure. As a result, we cannot ensure or warrant the security of any information you provide to us.

8. USER RIGHTS

You have certain rights to your personal information. These may include the right to:

  • Access and/or correct your personal information
  • Delete your account
  • Withdraw consent to the processing of your personal information
  • Unsubscribe from marketing communications
  • Request additional information regarding our personal information governance practices, including details regarding what personal information is collected about you, the categories of persons who have access to your information, and how long your information will be retained
  • Request a copy of your data (data portability)

If you receive a delivery from us or a Seller fulfilling an order through our Platform, and you no longer wish to receive such deliveries, you may contact us to ask that future deliveries to your address through our Platform be blocked.

If you choose to withdraw consent from processing of personal information we need to provide our services, we may no longer be able to provide those services to you.

The rights you have may vary based on your location and are subject to limits set out in applicable law. To help protect against fraudulent requests, we may ask you for information to confirm your identity before granting access to your personal information.

9. CHILDREN'S PRIVACY

The Platform is not intended for individuals under the age of majority where they live. We do not knowingly collect personal information from children.

10. INTERNATIONAL USERS AND INTERNATIONAL TRANSFERS OF PERSONAL INFORMATION

Our services are currently limited to certain regions. However, users outside of Canada who access the Platform acknowledge and consent that their data may be transferred to and processed in Canada.

Personal information that we collect may be stored and processed in Canada and outside your jurisdiction of residence, in any other country in which we or our service providers maintain facilities, including Canada and the United States. Personal information processed and stored in another country may be subject to disclosure or access requests by the governments, courts, or law enforcement or regulatory agencies in that country according to its laws.

By using our Platform or by providing us with personal information, you consent to any such transfer of information outside of your country.

11. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time. Changes will be posted on this page with a revised "Last Updated" date. Continued use of the Platform constitutes your agreement to the updated terms.
